Since 1994, Bradford
S. Moyer has specialized in environmental insurance, insurance, and environmental
law, both litigated and non-litigated. Mr. Moyer has handled a broad range
of complex, multi-party environmental and other insurance matters in Michigan, Indiana, Illinois, Ohio, Wisconsin, Minnesota,
Kentucky, Alabama,
Tennessee, Oklahoma,
Texas, and California, involving Fortune 500
companies and environmental sites in more than 30 states. Mr. Moyer also
has handled a variety of other insurance-related matters including
litigation involving asbestos, defective products, professional liability,
malpractice, and errors and omissions insurance as well as legal issues
involving insurance brokers and agencies. Mr. Moyer became a principal of
the firm in April 2000.
Mr. Moyer also has handled litigation, negotiations and transactions
involving the Comprehensive Environmental Response, Compensation &
Liability Act (CERCLA), the Resource Conservation and Recovery Act (RCRA),
and the Michigan Environmental Response Act and the Leaking Underground
Storage Tank Act, Parts 201 and 213 of Michigan's Natural Resources and
Environmental Protection Act (NREPA), respectively, as well as regulatory
and permitting issues involving the Clean Air Act and the Rivers and
Harbors Act. Mr. Moyer also has experience litigating toxic tort claims and
other matters involving medical and scientific experts.
In addition to his insurance and environmental practice, Mr. Moyer
currently heads the firm's Information Technology Law practice group
focusing on Internet law, software, e-commerce, online liability, and
related information and technology-related liability and litigation
matters.
Mr. Moyer is the author or editor of several legal publications, including
co-author of Effectively Utilizing Computer Animation in Environmental
Litigation, Michigan Bar Journal, February 1997, serving as Editor for Indiana
Litigation Forms and Analysis (1994) for Lawyers Cooperative Publishing
Company, and author of The Future of Rutan v Republican Party of
Illinois: A Proposal for Insulating Independent Contractors from Political
Patronage, 28 Val. U.L. Rev. 375 (1993).
Mr. Moyer is admitted to the State Bar of Michigan, the State Bar of
Indiana, and the District of Columbia Bar.
Mr. Moyer also is admitted to the United States District Courts for
the Eastern and Western Districts of Michigan, Northern District of Ohio,
Northern District of Indiana, Southern District of Indiana, and Northern
District of Oklahoma, and the United States Court of Appeals for the Sixth
Circuit, and has been admitted pro hac vice in insurance matters in
state courts in Ohio, Illinois, Indiana, Minnesota and Wisconsin. Mr. Moyer
is a member of the Environmental Law Section and Computer Law Section of
the State Bar of Michigan, and is a member of the American and Federal bar
associations, the Michigan Economic Developers Association, the Michigan
Association of Environmental Professionals, and the Michigan Information
Technology Roundtable. Mr. Moyer is
also actively involved in several committees of the Tort Trial and Insurance
Practice Section of the American Bar Association, including currently
serving as a Vice Chair and as Newsletter Editor for the Insurance Coverage
Litigation Committee.
Mr. Moyer graduated from Valparaiso University School of Law where he
served as Executive Editor of the Valparaiso University Law Review
and as a member of the Midwest Environmental Law Caucus. Mr. Moyer
graduated from the University of Michigan with a B.A. in Organizational Behavior
and Human Resource Management and is a former member of the University of Michigan Football Team.
Mr. Moyer materially assisted in achieving a successful result in a $9
million jury trial in 1995 and has defeated several multi-million dollar
insurance and other claims on behalf of firm clients.
